General Conditions:

• Prices stated are per person and include GST.
• Confirmation of all services is subject to availability at the time of booking and bookings are essential.
• Concessional fares apply to holders of Australian Seniors cards, YHA, VIP or NOMAD members, tertiary students and ISIC cardholders only. Student fares apply to students aged between 13 and 17 years inclusive. Identification must be presented at our office prior to boarding Oceanic Cruises vessels. Any further advertised discounts will apply to the full adult fares only; there is no further discount on already discounted fares or package prices.
• Unpaid seats will be released to stand-by passengers to (10) minutes prior to departure.
• Ticket holders are entitled to carriage upon Oceanic Cruises vessel on the date and time advertised or reflected on the face of the ticket, when issued. This entitlement is subject to the terms and conditions set out and listed on the tickets provided prior to boarding.
• Oceanic Cruises will endeavour to provide carriage on the vessels as shown in this publication however in the case of unforeseen circumstances substitute vessels may be use, this is decided at the discretion of Oceanic Cruises.

Cancellation Policy:

• Whilst cancellation is unusual, the decision to operate any particular cruise will depend on the prevailing/predicted weather conditions and will take into account passengers' safety and comfort. Services may be cancelled at any time with or without notice. As a general principal, Oceanic Cruises' policy is not to impose Cancellation Fees whenever possible on the ferry component of any cruise.
• Cancellation fees for Oceanic Cruises' packages/tours, where a third party is involved (such as a tour company, hotel, restaurant) are as follows:
  - Cancellations outside 14 days of travel - no charge
  - Cancellations within 14 days of travel - 25% fee
  - Cancellations within 24 hours or "No Shows" notified after the advertised cruise departure time - 100% fee
• Cancellation fees are subject to change without notice and are charged at the discretion of Oceanic Cruises and their suppliers.

Validity:

All fares and itineraries in Oceanic Cruises brochure are correct at time of printing; Oceanic Cruises reserve the right to alter schedules, touring and/or accommodation packages or prices without notice.

Condition of carriage

"Company" means Oceanic Charters the owner of the vessel. "Vessel means the "Oceanic and/or any substitute vessel. "We" or "Us" are the owner, charterer, operator and Manager of the Vessel and or their respective agents, representatives and servants. "Crew" means the master, officer and shore personnel employed by Us. "Sub-Contractor" means the Operator who We contract with to undertake performance of the carriage obligations under this contract.

You are entitled to carriage upon the Vessel on the date specified on your confirmation. The entitlement is subject to the terms and conditions set out below.

WE ARE NOT COMMON CARRIERS. We reserve the right to refuse carriage to any person for any reason.

We reserve the right to alter the time and place of the departure and arrival of the Vessel

You shall at all times abide by the rules and regulations enforced by the Crew.

If we do not perform the intended carriage or any of its other obligations under this contract, We shall have the option to either refund the cost of the function to You OR perform the carriage at another time that is suitable to both parties but shall have no further obligations or liability to you.

In the performance of our obligations under this contract, We and the Vessel shall not be responsible for
1. loss of life or personal injury to you; and/or
2. loss or damage to your property including but not limited to a claim caused by any act of negligence or any default or breach of contract on our part

We reserve the right to apply any limitation of liability applicable under the International Convention on Limit of Liability for Maritime Claims, 1976 (as amended), the west Australian Marine Act, 1982 or any other applicable legislation where we are entitled to do so.

These terms and conditions do not:
1. purport to exclude, restrict or modify
2. have effect of excluding, restricting or modifying the application in relation to the supply of any goods or services pursuant to this contract.
3. All or any of the provisions of Part V of the Trade Practices Act 1974; and/or
4. The provisions of the Fair Trading Act (WA) 1987; or
5. The Sea-Carriage of goods Act (WA) 1909; or
6. Any other applicable State or Commonwealth legislation, which by law cannot be excluded, restricted or modified

Any cause which excludes or limits Our Liability in respect of carriage under the terms and conditions of this contract, applies to Us in acting as agent of and trustees for each of Our servants, Crew and Sub-Contractors. In effect Our servants, Crew and Sub-Contractors are parties to this contract. So far as the exclusions and limitation clauses are concerned and as may be necessary to give effect to this clause, We shall hold the benefit of these conditions for Our servants, Crew and Sub-Contractors.

The crew shall not be under any liability to You while acting in the course of or in connection with their employment or loss, damage or delay including but not restricted to any act, neglect or default on their part.

A Sub-Contractor who is to perform the intended carriage under this contract shall in no circumstances be under any liability to You for any loss, damage or delay.

You undertake with Us and the Vessel that any claim or allegation which imposes any liability upon the Servants, crew or sub-Contractors. If any such claims or allegations are made against Our servants, Crew and Sub-Contractors You must Indemnify the Company against the consequences.
